Dirt and Hills LLC (”we,” “our,” “us”) operates The Durable Athlete application (the “App”). This Privacy Policy explains how we collect, use, and protect your information.
1. INFORMATION WE COLLECT
From You Directly:
Account Information: Name, email address, password, date of birth, gender
Profile Information: Fitness level, training history, event goals, injury history
Training Notes: Workout feedback, perceived exertion, recovery status
From WHOOP:
When you connect your WHOOP account, we collect:
Recovery score, strain, and sleep data
Heart rate variability (HRV)
Resting heart rate
Workout activities and metrics
Sleep stages and quality metrics
Respiratory rate
You control what WHOOP data is shared through your WHOOP account settings.
Automatically:
Usage Data: App interactions, features used, session duration
Device Data: Device type, operating system, IP address, browser type
Performance Data: Error logs, crash reports, app performance metrics
2. HOW WE USE YOUR INFORMATION
We use your information to:
Generate personalized training plans
Calculate readiness assessments and adapt workouts
Sync WHOOP recovery data with training recommendations
Improve App functionality and user experience
Communicate important service updates
Ensure account security and prevent fraud
Comply with legal obligations
3. HOW WE SHARE YOUR INFORMATION
We do not sell your personal information.
We share information only with:
Service Providers: Base44 (app hosting), payment processors, email services, analytics providers. They are contractually obligated to protect your data and use it only for specified purposes.
WHOOP: When you authorize the connection, we access your WHOOP data based on your permission settings. WHOOP’s privacy policy governs how it handles your data.
Legal Requirements: We may disclose information to comply with legal obligations, court orders, or to protect our rights and safety.
Business Transfers: If we merge with or are acquired by another company, your information may be transferred to that company. We will notify you before this occurs.
4. DATA SECURITY
We protect your information through:
Encryption in transit (TLS/SSL) and at rest
Secure password hashing
Limited employee access
Regular security assessments
No method of transmission is 100% secure. You use the App at your own risk.
5. DATA RETENTION
We retain your information while your account is active and for up to 30 days after deletion. Some information may be retained longer for legal compliance (e.g., billing records: 7 years).
6. YOUR RIGHTS
Access & Correction: Update your information in App settings or contact us to request access to your data.
Deletion: Delete your account in App settings or email us. Some data may be retained for legal purposes.
WHOOP Integration: Disconnect WHOOP in App settings (Account > Integrations). This stops future data sync but doesn’t delete previously synced data.
Opt-Out of Marketing: Click “unsubscribe” in emails or adjust settings in Account > Notifications.
California Residents: You have the right to request information about data collected, request deletion, and opt out of sales (we don’t sell data). Email us with “California Privacy Request” in the subject line. We will respond within 45 days.
7. CHILDREN’S PRIVACY
The App is not intended for users under 18. We do not knowingly collect information from persons under 18. If we learn we have collected such information, we will delete it promptly.
8. CHANGES TO THIS POLICY
We may update this Privacy Policy. Material changes will be communicated via email with 30 days’ notice. Continued use after changes constitutes acceptance.
SUMMARY
